These Terms of Service ("Terms") govern your access to and use of the Testimonials website and service for collecting, managing, and displaying customer testimonials and reviews. By using our services you agree to these Terms.

Accounts

You are responsible for the information you provide and for activity under your account. You must give an accurate email address and keep your access credentials secure. You are responsible for the actions of anyone you invite to your account.

Acceptable use

You agree not to misuse the service, including by attempting to access data or accounts you are not authorized to, interfering with the service, reverse-engineering it, scraping or bulk-extracting data, sending unsolicited or unlawful communications through our request links, or using the service to violate any law or third-party right. You may not upload content that is illegal, infringing, defamatory, or harmful.

Your content and ownership

You retain all rights to the testimonials, reviews, media, and other content you collect and manage through the service. We claim no ownership over your content. You grant us the limited rights needed to host, process, and display that content so we can provide the service to you, such as storing video and rendering it in your walls and widgets. We do not sell your content and we do not reuse your customers' content for our own marketing without your permission.

Consent and content responsibilities

You are responsible for having a lawful basis and the necessary permissions to collect and display the testimonials you gather. Our collection flow captures your customer's consent when they submit, but you remain responsible for how you request, use, edit, and publish testimonials, including honoring any request from a customer to remove theirs. You must not present testimonials in a false or misleading way or edit them so they no longer reflect what the customer said.

Plans and billing

Paid plans are billed in advance on a monthly or yearly basis as shown at signup, in US dollars. Pricing is flat and unlimited as described on the pricing page, with no per-space, per-seat, or per-minute metering. You can cancel anytime and your plan will not renew for the next period. Fees already paid are generally non-refundable except where required by law. We may change pricing with reasonable notice.

Cancellation

You may cancel your plan at any time from your account or by contacting us. On cancellation you keep access until the end of your current billing period, after which paid features stop. You can export your testimonials before your account is closed.

Sample and illustrative content

Any example testimonials, names, quotes, or results shown in the demo or on marketing pages are illustrative sample content provided to show how the product behaves. They are not real customers of yours and should not be treated as such.

Service availability

We work to keep the service available and reliable but do not guarantee uninterrupted operation. Enterprise plans may include specific service-level agreements.

Disclaimers and liability

The service is provided "as is" and "as available" without warranties of any kind, including any warranty that it will be uninterrupted, error-free, or suitable for a particular purpose. To the maximum extent permitted by law, Testimonials is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.

Governing law

These Terms are governed by the laws of the state in which Testimonials is organized, without regard to its conflict-of-laws rules. The specific governing jurisdiction and venue are set out in your order or account agreement.

Termination

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms. On termination, we will delete or return your information as described in our Privacy Policy.

Changes

We may update these Terms from time to time. Material changes will be communicated, and continued use after changes means you accept the updated Terms.
